1. Acceptance of Terms

By accessing and using this website and services provided by Diamond Render & Texture ("Company," "we," "us," or "our"), you accept and agree to be bound by and abide by the terms and conditions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Diamond Render & Texture's Site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Use the materials for any commercial purpose or for any public display

3. Quote Requests and Service Agreements

Quote Request Submission

• Quote requests must contain accurate property and contact information
• You are responsible for maintaining confidential login credentials and communication
• Quote requests are non-binding estimates unless confirmed in writing
• All parties must be 18 years of age or older to enter into a service agreement

Service Policies

• Services are rendered at the location specified in the quote or contract
• The Company reserves the right to reschedule work with reasonable notice
• Work must commence at agreed times; delays by the customer may affect project timeline
• All parties agree to comply with health, safety, and property guidelines
• Property owner is responsible for access to the work area

Health and Safety

• Clients assume responsibility for disclosed hazards on the property (asbestos, lead, etc.)
• The Company is not liable for undisclosed hazardous materials or conditions
• Clients with health concerns should inform the Company before work commences
• All work must comply with Australian Health and Safety Standards

4. Payment Terms

• Payment is due according to the terms specified in the service agreement or invoice
• We accept payment methods listed on our Site or specified in the contract
• The Company reserves the right to decline or suspend work if payment is not received
• Prices are based on the scope of work outlined in the quote; variations will incur additional charges
• Invoices are due within the timeframe specified (typically 7-30 days)

5. Cancellation and Rescheduling Policy

Client Cancellation

• Work can be canceled with 7 days notice for a full refund of deposits
• Cancellations with less than 7 days notice may forfeit the deposit
• Cancellations after work has commenced will be charged at the agreed rate

Company Rescheduling

• The Company may reschedule work due to unforeseen circumstances (weather, equipment, illness)
• Clients will receive notice and offered alternative dates or alternative arrangements

6. Warranty and Quality Assurance

Diamond Render & Texture warrants that all work will be performed professionally and in accordance with industry standards. Defects in workmanship will be remedied within 30 days of project completion, provided the defect is reported in writing. Warranty does not cover normal wear, weathering, or damage caused by third parties.

7. Intellectual Property Rights

All content on the Site, including text, graphics, images, videos, logos, and software, is the property of Diamond Render & Texture or licensed to the Company and is protected by international copyright laws. Unauthorized reproduction or distribution is prohibited.

8. User-Generated Content

If you submit, post, or display content on our Site (photos, testimonials, reviews), you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content for marketing purposes. You warrant that you own or have the necessary rights to the content you submit.

9. Limitation of Liability

In no event shall Diamond Render & Texture, its owners, employees, or agents be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or services, including but not limited to loss of profits, data, or business interruption.

The Company's total liability shall not exceed the amount paid for the services in question or $10,000 AUD, whichever is lower.

10. Indemnification

You agree to indemnify and hold harmless Diamond Render & Texture from any claims, damages, losses, liabilities, and expenses arising from your use of the Site, violation of these Terms, or infringement of any rights.

11. Disclaimer of Warranties

The Site and services are provided on an "as-is" and "as-available" basis. The Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Work quality is limited to industry standards and cannot guarantee permanent durability in all environmental conditions.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of South Australia, and you irrevocably submit to the exclusive jurisdiction of the courts located therein.

13. Dispute Resolution

Any dispute arising from these Terms shall first be subject to good faith negotiation between the parties. If unresolved, disputes may be submitted to mediation or arbitration in accordance with South Australian law.

14. Modifications to Terms

The Company reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site constitutes acceptance of modified terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
